19.4.A.21 Non-Commercial Short-Term Rental Special Exception Interim Zoning District

A. Intent of the District

The intent of the Non-Commercial Short-Term Rental Special Exception Interim Zoning District is to prohibit the issuance of Non-Commercial Short-Term Rentals the exceed block limitations through the Special Exception process.

B. Boundaries

The Interim Zoning District applies to all zoning districts in which Special Exceptions for Non-Commercial Short-Term Rentals are allowed.

C. Prohibited Uses

No Special Exception shall be granted for any Non-Commercial Short-Term Rental application received after September 19, 2024.

D. Appeal Procedure

Determinations as to the applicability of the Interim Zoning District to any particular property shall be made by the Department of Safety and Permits. Appeals shall be submitted to the Executive Director of the City Planning Commission, whose staff shall review and make recommendations relative to the appeal within sixty (60) days of receipt. A successful appeal shall document extraordinary and unusual circumstances related to the short-term rental application process, other than economic injury. 

The Council shall have sixty (60) days from receipt of recommendation to approve, deny, or modify the appeal recommendation by motion.

E. Expiration

The IZD shall be in effect for a period of one year and is subject to extension in accordance with Article 19, Section 19.3.B.3 of the Comprehensive Zoning Ordinance.
